Product liability insurance protects you from having to pay damages if your product:

Has improper, incorrect or insufficient warnings and instructions: Many products have certain acceptable risks that can be encountered during use. Such as coffee makers which allow steaming hot water to drip into their carafes. It’s your responsibility to make sure that your product is labeled correctly to warn of these risks. You must also provide instructions that explain all risks and what one must do to avoid them.

Has a defect in its design: You designed your product to work effectively, but, it is possible that you may have missed something in the design that makes it unsafe during, before or after use.

Suffers a production flaw: No matter how tightly monitored your manufacturing and production process is problems, oversights and flaws can occur making your product dangerous to your consumers.

Regardless if you have a start-up operation, high-risk products or a product in a specialty field, we can create a product liability insurance policy to cover your specific risks. You can’t afford to skip this important coverage because product liability insurance cannot always be backdated. Just one expensive claim could ruin your company’s entire financial future.
To start with, create, or revise, your business plan and financial projections. Secondly, develop a marketing strategy. Lastly, pay your insurance premiums.

Don’t, however, pay your insurance premiums thoughtlessly. Before you make those payments you need to review your insurance policies and make sure the coverages they present are still relevant to your ever-changing company.

Why should I review my insurance policy?

As a business owner your time is taken up by the everyday events of your business. As such you may not recognize all the small modifications that could potentially affect your insurance policies. A change that is commonly neglected is the addition of newly purchased equipment for the business. Whether you improve your existing equipment and supplies or add totally new items to the roster, you need to make your insurance company aware of these changes. Your existing policy may not provide adequate coverage for your new equipment and that your limits or exclusions need to be adjusted. Additionally, you need to find out if you are being reimbursed for actual cash value or replacement value. When you have irreplaceable equipment, an ‘actual cash value’ reimbursement may not be enough to make you whole again and help you replace the equipment if it is damaged or stolen.

When assessing your business insurance consider also, any adjustments made to company cars. If a new vehicle was purchased for the business, you may need to increase the policy limits in order to protect its value fully. On the other hand, if your company vehicle has lost value during the year, you may want to lower your auto policy limit in order to accommodate its reduced value. This will also reduce your premium—normally a very welcome idea to business owners.

Take into account also the addition of coverage for any new business ventures that have developed. Just because you have liability, car insurance and other relevant coverages for your main business venture, doesn’t mean that all other business ventures you enter into are adequately covered. New lines of business could pose a greater risk to the insurer and could potentially include aspects that need additional endorsements on your policy.

So before you write out that insurance premium check each year, inspect your policies and observe whether there have been any staffing, equipment, or process changes that would affect any of them. After all, an insurance policy can only offer effective protection if business owners provide all information as necessary as to what it is that needs protecting. These vital associates are referred to as key employees. Key person life insurance pays your company a death benefit when one of these key employees passes away, but is it something you need?

How hard is your employee to replace?

Employees with common skills and business contacts might be easy to replace, but a high-level employee with specialty knowledge or experience, or one with a creative bent that your business values, could be exceedingly difficult to replace. A key person life insurance policy can give the additional resources your company will need in order to find and hire a replacement.

Will you suffer financially from their loss?

Losing a key person could result in a loss of sales or resources for your business. If your employee is a creative specialist or involved in the production of your products or service he or she may be imperative to the continuation of your business. Depending on the role the key person has in your company, you could even lose clients after their death, erasing important streams of income for your company. A key person life insurance policy can offer a financial resource to help bridge this gap in income until you are able to hire a replacement with similar attributes.

Can you do what they do?

Sometimes, key employees have talents or knowledge that the business owner doesn’t and sometimes, the owner can do what the key person does. If that is the case for your business, then you may be able to get by without the key person insurance policy. But if the workload after a key employee’s death will be more than you can handle, a key person policy will give you the funds you need to hire temporary employees to help take on some of the other duties you’ll no longer have time for.

Is the insurance for you?

In many cases, the owner of the business is the key employee. When a business owner dies, it is up to his or her family and heirs to take over operations and the proceeds from a key person insurance policy can give them the funds they need to keep the business running or pay them an income until the business sells.

Key person insurance is another important tool that business owners should use in order to protect their business assets and help keep their business afloat when the loss of a key employee threatens it. But your Plano home insurance policy isn’t just about surface benefits—there are actually some hidden benefits in the coverage that you might not even know you have. Are you curious? Here are just a few examples:

Far-flung property: You already know that your home insurance covers the personal property in your home, but did you also know that it covers this property no matter where it is in the world, as long as it’s normally kept at the insured residence? That means if your luggage is damaged while you are on vacation during an insurable event that would normally be covered in your home insurance policy, you could qualify for reimbursement for the actual or replacement value of the items. There are some pretty stiff limits imposed on this coverage, and exceptions include property that is being moved because renovation makes the insured residence uninhabitable, but it’s still a benefit that could come in handy.

Theft, forgery and acceptance of counterfeit money: If your credit cards are stolen and used, your signature forged on stolen checks, or you are given counterfeit money that you believed was real at the time of acceptance, your home insurance policy may entitle you to a small reimbursement of the losses that result, even if they don’t exceed your deductible.

Loss of use: If an insurable incident makes your home uninhabitable, your insurance policy may give a benefit for loss of use. This will pay the portion of the living expenses for the temporary arrangement that equal the policyholder’s normal living expenses. And if the whole home isn’t uninhabitable, just the part that is normally rented out to others, your insurance policy may cover all or part of the loss of the rental income.

Every insurance policy is different, so before assuming that any of the above home insurance benefits is applicable to you, take out your policy or call your agent to investigate further. And whether you get the above benefits or not, it’s a good idea to read your policy so you can find all the hidden coverage nuggets that may lurk within.

This sentence is an oft-used piece of age-old advice that is age-old for a very simple reason—it’s one of those important rules in life that is good to follow. Generally speaking, when someone borrows something of yours, you are left with the responsibility of replacing the item if it is damaged, assuming that the borrower doesn’t step forward to do so. And when the item lent is expensive, you could really be digging a financial grave by lending it. So the adage advising not to lend or borrow is a great guideline for life, but when it comes to lending your car to other licensed drivers, this bit of advice might just be a little too conservative.

The auto insurance you have on your vehicle is just that—vehicle insurance. It covers your car if it is driven by a spouse, friend, roommate, child, distant cousin—anyone you give permission to drive it. That doesn’t mean that anyone with access to the vehicle and keys is covered, but anyone that you’ve given verbal permission to use the vehicle is. Of course, there are a couple of caveats. The driver you loan the car to must be a properly licensed driver or, if under permit, must have a licensed driver with him or her. When the driver is a person who regularly drives your car (such as a licensed teenage son or daughter), you may be retroactively charged insurance premiums for that individual after an accident, for the simple fact that they probably should have been listed on the policy as a regular driver of the vehicle.

If you’ve ever rented a car, then you also know that your auto insurance coverage extends to the cars you drive outside the one you own. So, if you, as a licensed driver, borrow a friend’s car and you cause an auto accident, the auto insurance on your friend’s car will be the primary resource for recouping damages. If your friend has no insurance or has a gap in coverage, then yours may be relied upon.

Your auto insurance coverage does not extend to the use of someone else’s car for commercial (or business) purposes and it does not cover damages to your vehicle if your car is being used for business at the time of the accident. In that case, you or the vehicle must be covered by a commercial insurance policy.

But when it comes to renters insurance, many people believe that they can get by without a policy. They assume that they are covered under their landlord’s property insurance policy and that this policy will reimburse them for any damages to their possessions and that they are not liable for any damages to the premises. Unfortunately, that is not always the case. Let’s take a look at four different scenarios and see how renters insurance could help in each.

It’s Saturday night and it’s time for your friends to come over and watch the NBA game. While inside your apartment, one of your friends slips on some water that you spilled on the floor but neglected to wipe up. He must go to the emergency room and the injury results in medical bills and missed work.

In this scenario, you are liable for your friend’s injury. You neglected to clean up the water and you created a potentially dangerous situation in doing so. If you have renters insurance, then the policy will cover the medical bills and may cover lost wages.

It’s the holiday season and you are cooking for your family and friends. The turkey is almost done, the mashed potatoes are whipped to perfection and the green bean casserole is sitting on top of the stove waiting to be served. Unfortunately, the wooden spoon that you left in the green bean casserole is hanging over the burner that you used to cook the mashed potatoes. It catches fire and your stove—along with your dinner—follows suit.

While your landlord’s insurance policy might cover you if a fire began due to bad wiring or faulty appliances, the event described above is something that you would be responsible for since it was the result of your negligence. If you have a renters insurance policy, then you won’t need to reimburse your landlord for damages out of your own pocket but can instead have your landlord submit the claim to your insurer.

After a trying day at work , you come home to your apartment tired and ready to relax. As you walk up to your front door you notice that it seems to be standing open—and you’re pretty sure that you didn’t leave it that way. You slowly ease toward the opening, craning your neck to try and avoid getting hurt if someone is actually in the apartment and you see that the door has been kicked in. As you step over the remains of the door and your eyes adjust to the low light of the room, you notice that your new television, stereo, gaming system and other valuables are gone.

In this situation, your landlord’s insurance would cover the cost of replacing and re-hanging the door. But a landlord or property owner’s insurance policy won’t cover your belongings that were inside the apartments, as those are the renter’s responsibility to insure with a renters policy.

You’ve finally decided to take the two weeks’ of vacation that you’ve been hoarding at work. You’ve gotten your passport, packed all your new vacation duds, and are ready to head out onto the open waters on a luxury cruise. Unfortunately, before you even get onto your ocean liner you realize that your luggage, including your camera, laptop and your new sandals, are gone. They’ve been stolen and you’d have to get your money back for this trip in order to afford to replace them.

There is probably no one on earth who would expect their landlord’s insurance policy to cover stolen luggage that isn’t even on the premises of their apartment building. But did you know that your renters insurance policy actually will cover stolen luggage?

Renters insurance helps ensure that you are made whole when you are the victim of a theft; it helps protect you from liability when someone is injured in your apartment and it ensures that you can reimburse your landlord if you cause damage to the building or appliances as the result of accident or negligent behavior. It is a comprehensive policy offering protection that would be a mistake to do without.
American Red Cross states that as many as 40% of small businesses do not resume operations following a disaster. Forming a plan and implementing safeguards can keep your business from becoming just another number.

We have provided the following steps to start a disaster plan:

Important Phone Numbers: Organize a list of emergency telephone numbers for employees so they know who to reach out to in case of a catastrophe. Your phonebook should include emergency management agencies, key personnel, utility companies, insurance company/agent, suppliers, contractors, and the landlord if applicable.

Make a critical response plan: Instruct employees whom they should contact in case of a disaster and what steps to take to prohibit injuries or additional property loss.

Actualize a communication plan and venue: Decide what method would be best to communicate with your employees, vendors, and customers in the occurence your office is inaccessible. Options could include email, website, or an offsite phone messaging system.

Maintain duplicate records: Routinely back up your computer files offsite. Also talk to your software providers to see if there is a way to access that data outside of the business.

Build an emergency kit: Have emergency supplies accessible - water, first aid kit, and tools. Make certain that all employees are aware where the kit is located.

Go over your insurance policy: In addition to coverage for your property, contact to your insurance agent about Business Interruption insurance. This vital coverage keeps income coming in when business comes to a standstill.

A disaster, such as a fire, may shut an organization down briefly. While the organization is not functioning, profit can end or decline considerably. Yet, costs carry on and may even rise during this time. This is where Business Interruption coverage comes into play. It is designed to protect the loss of wages, temporary moving costs, and ongoing costs such as earnings, utilities, and housing expenses.

Coverage Limitations

Insurance is devised to financially return someone to where they would have been had the incident not taken place. Therefore, the organization would need to present evidence that shows what the business would have actually lost in profit. It is encouraged that organizations possess duplicates of at least 12 months of financial entries someplace else for this very reason.

Most plans have a waiting period, for example 72 hours, before coverage will start. The max sum compensated each month as well as the total sum disbursed for the loss of revenue is measured when the coverage is obtained. The policy will also determine a maximum period the coverage will last. So for instance, a policy may state insurance will only continue for 120 days, include a ceiling of $120,000 with a monthly maximum of ¼. This expresses that the business owner would only be eligible for a max award of $30,000 each month with a $120,000 maximum disbursed over the course of 120 days.

Extra Expense

Extra Expense insurance is used to provide assistance with extra cost an organization incurs to keep the business running, such as moving to a transitory spot while the main building is being fixed. This insurance is presented in addition to Business Income coverage.

Extended Period of Indemnity

Usually, Business Income coverage will end when organizational activities are restart. Yet, just because business starts again, doesn’t mean it will be business as usual. Extended Period of Indemnity can furnish insurance in the meantime, from the period the organization is able to re-open its’ doors to when the income swells to normal income levels. Nonetheless, there will be a cutoff established as to how long the insurance will in effect as the insurance carrier cannot promise compensation recovery.

How to purchase Business Interruption Coverage

Business Interruption insurance is not purchased separately. It can be tacked on to a commercial property insurance policy or a business owner’s policy.

Below are some tips for items to add to your disaster plan and a couple of steps to take before a disaster hits.

The Plan

Set parameters for office close down: Storms come upon us—luckily—with warning. At any given time during storm season you may face tornado, tropical storm or hurricane watches or you might face warnings. You need to decide what parameters will surround the closing your office and notification of employees to not come in.

Determine how and when to notify clients: If your work is going to be interrupted and you are not going to be able to service clients, then you need to develop a notification system for your clients. You can use a remote email, update your website with a message about the shut-down of your office and even ask your employees to make some phone calls from home or wherever they evacuate to.

Determine parameters for reopening your office: Your disaster plan should also contain specific information about when you expect work to begin again after the disaster. Be sure to consider possible post-disaster clean-up efforts and safety issues and try to be considerate of the personal needs of your employees during this time.

Things to do BEFORE the Disaster

Create a remote working location: If you have operations that need to continue, no matter what the weather, then you need to have a remote working location. The location should be safe, removed from the center of the disaster, and have all the secondary supplies that you need to continue working. In your disaster plan, set the parameters for when you and your associates will move to the remote location, what equipment to bring and which employees are expected to accompany you.

Develop an easy-to-access contact list: You may need to contact clients or service providers if you close down your office. Make sure you have all your phone numbers and emails in one central location that you can easily grab if you decide to evacuate. You should also keep a copy in a remote location.

Have a buy-sell agreement: If something should happen to you during a disaster, your family could be stuck in a precarious financial position, especially if your business is adversely affected by the disaster or your death. Having a buy-sell agreement in place ensures that your family will receive the fair market or book value price for your half of your business and your business partner will be charged with the responsibility of continuing the business.

Buy proper commercial property insurance: If your property is damaged during a storm or other disaster, you won’t get reimbursed unless you have the appropriate commercial property insurance. Even if you work out of your home, your homeowners insurance won’t cover the damage unless you have special endorsements that spell out the coverage for your home office supplies.

Set up an automatic system for payroll: You and your employees still need to get paid—especially during a disaster. Make sure you consider setting up automatic bank transfers or some other kind of system to get your employees paid.

Disaster planning is something that should be taken seriously by every business owner—whether they employee a staff of 75 or just themselves. Doing so will help keep you calm and collected during a disaster and will help ensure you have a business to go back to after one.
Well I have arrived! For the first time I am getting to visit my team in Qingdao. J & J outsources most of our CSR duties to China. We have a great team here in Qingdao. The team is lead by Brenda. A great organizer and enforces by use of a stapler. Victor and Jackie are the CSR’s. Victor manages our multi-line and VIP accounts. Jacquelyn, who is new to the team manages the rest of the accounts.

The Qingdao office is 13 hours ahead of the dallas office, so while we are all sleeping they are busy answering all the emails that were sent to our office in the morning. The Dallas office handles the sales and emergency situations. This has worked out for us very well. Somebody is always available to answer any question 24 hours per day 24 hours 5 days a week in English and Chinese. Well got to run to a meeting, will try to update you more on the operations in China as I learn about them.
</a10:content>

Liability Insurance for Risks in the Manufacturing Arena

The Hartford’s Specialty General Liability Unit and Jordan & Jordan Combine to offer Liability Insurance for risks in the manufacturing arena.
